New Report Sheds Light on Secretive Deportation Practices; Reveals Evidence of Systemic Violations of Basic Rights for Immigrants in Deportation Proceedings.


“Deportation Without Due Process,” a groundbreaking report, analyzes thousands of never-before-released government documents revealing evidence of widespread misuse of the “stipulated order of removal” program.  The lead author of the report is Western State Professor Jennifer Lee Koh, who co-authored with Stanford Law School professor Jayashri Srikantiah and National Immigration Law Center (NILC) attorney Karen Tumlin.  For nearly a decade, the government has used this little-known program to deport more than 160,000 noncitizens without providing them hearings before immigration judges or adequately informing them of the rights they forfeit by signing the removal order.  The “stipulated orders of removal” program encourages immigrants to waive their right to a court hearing in exchange for expedited deportation. Through this process, immigrants have neither been properly advised of their legal rights, nor adequately informed that their deportation will have lasting, often permanent impact. The authors of this report obtained government records through a Freedom of Information Act lawsuit filed on behalf of NILC, the American Civil Liberties Union of Southern California and the National Lawyers’ Guild San Francisco Chapter, and carefully analyzed thousands of pages of government data, correspondence, and other information about this controversial program. Their startling findings indicate that the program has violated the basic civil rights of immigrants, the vast majority of whom are placed into the deportation pipeline as a result of simple immigration infractions.    For a copy of the report, click here.
