Probate Clinic

The Western State College of Law Probate Clinic (WSCLPC) provides students practical experience in probate law. This 4-unit course integrates hands-on clinic work with comprehensive classroom instruction, preparing students to effectively assist clients as they navigate the complexities of probate court.

Course Structure

The WSCLPC is divided into two main components:

1. Live Client Clinic (2 Units): Under the supervision of clinical faculty and pursuant to the State Bar’s Rules Governing the Practical Training of Law Students, students will provide advice and legal assistance to individuals appearing in propria persona on conservatorship, guardianship, probate estate, and trust matters. Students will assist individuals with various aspects of these matters while acquiring the skills necessary to advocate for clients in court.

   Students may assist individuals with uncontested administrative procedures, advising on the next steps in their respective cases, or preparing for and conducting evidentiary hearings. Students will have the opportunity to develop and exercise fundamental lawyering skills such as:

   • Interviewing
   • Case management
   • Preparation of legal documents
   • Making appearances in court
2. Classroom Seminar (2 Units): This component consists of in-person classes held on the WSCL campus. Through a combination of lectures, exercises, and discussions, students will gain a comprehensive understanding of relevant Probate Code sections and procedures, directly applicable to clinic work.

Prerequisites

Successful completion of Civil Procedure II, Evidence, and Estates (or concurrent enrollment in Estates) is required to ensure students have the foundational legal knowledge necessary to succeed in this rewarding program.
